Terms of Service
These Terms of Service (“Terms”) govern your use of our website and services provided by Placidity Inc, doing business as Placidity Pro Painting and Placidity Renovations (“Placidity,” “we,” “us,” or “our”). By requesting an estimate, accepting a quote, using our website, or otherwise engaging our services, you agree to be bound by these Terms.
Placidity Inc is located at 222 Lakeview Ave, Suite 800, West Palm Beach, FL 33401, and operates placiditypropainting.com and placidityrenovations.com under these Terms.
1. Acceptance of Terms
A binding agreement is formed when a client accepts a quote — whether by signature, payment of a deposit, or acceptance through our website or a linked form. The accepted quote defines the agreed scope of work, pricing, and timeline for the project.
2. Client Eligibility & Responsibilities
By engaging our services, you represent that you are at least 18 years of age, legally competent to enter into a contract, and either the owner of the property or otherwise authorized to approve the work. Clients are responsible for providing reasonable site access, maintaining a safe work environment, and protecting personal belongings and landscaping in and around the work area.
3. Estimates, Payment & Late Fees
A deposit is due upon acceptance of a quote, with the remaining balance due as specified in your quote or invoice. Any unpaid balance not paid when due accrues interest at 18% APR, or the maximum rate permitted by law, whichever is lower.
4. Changes to Work
Any changes to the agreed scope of work — including additional materials, labor, or services not included in the original quote — require a documented Change Order, agreed to in writing by both parties, before that additional work begins.
5. Limitation of Liability
To the fullest extent permitted by law, Placidity’s maximum liability arising out of or related to our services is limited to the greater of (a) the total payments made by you to Placidity in the preceding twelve (12) months, or (b) $5,000. Placidity is not liable for indirect, incidental, or consequential damages.
6. Dispute Resolution
If a dispute arises, the parties agree to first attempt to resolve it through good-faith mediation within thirty (30) days of written notice of the dispute. If the dispute remains unresolved after mediation, it will be settled by binding arbitration administered under the rules of the American Arbitration Association (AAA), venued in Palm Beach County, Florida.
7. Intellectual Property
Placidity retains all rights to work products, project designs, and photographs of completed work, unless those rights are expressly transferred to you in writing. Placidity may use photographs of completed projects for portfolio, marketing, and promotional purposes unless you request otherwise in writing.
8. Website Use & Job Applications
By submitting a job application, resume, or related materials through our website, you grant Placidity a non-exclusive, royalty-free license to use, review, and store those materials for recruitment and hiring purposes.
9. Warranties & Disclaimers
Placidity performs work in a professional and workmanlike manner consistent with industry standards. Except as expressly stated in your quote or a separate written warranty, our services are provided without other warranties, express or implied, to the fullest extent permitted by law.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, and any legal proceedings not otherwise subject to arbitration will be brought in the state or federal courts located in Palm Beach County, Florida.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. The “Effective Date” at the top of this page indicates when these Terms were last revised. Continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
